Mass. Bill on Film Depictions-- 1997

Massachusetts Bill Rankles Hollywood

In response to the production of a Disney film about the Woburn toxic-waste case, the Massachusetts state legislature has passed a bill requiring producers to obtain permission before making movies about people's life stories. The film, A Civil Action, is the story of how eight families of children with leukemia hired a lawyer to prove that the town's water supply was responsible for their children's illnesses. The families received an $8 million settlement from one of the companies accused of dumping the waste. The film is based on the book of the same name by Jonathan Harr.

House Bill 4752, while well-intentioned, would place veto power in the hands of those who could use it to silence criticism of themselves and stifle debate.

Jack Valenti, President of the Motion Picture Association of America (MPAA), said the bill "seeks to shackle one of the dearest freedoms we possess as a nation, our right to free expression." The MPAA has said that the law could tie producers' hands with potentially limitless lawsuits; even famous people like the Kennedys would be able to control how their stories get told in movies and on television. Under civil law, those whose lives or images are portrayed in the media can only sue if they have been harmed in some way; A Civil Action will not use the real names of any of the victims.

Acting Governor Cellucci, who has campaigned aggressively to attract film business to Massachusetts, has said he would veto the bill.
